Case study: CoinShares

Challenge

CoinShares, a pioneer in digital asset investment and the first to launch regulated Bitcoin investment products, sought to deepen its understanding of the evolving regulatory environment for crypto-assets across the EU. With its crypto exchange-traded products (ETPs) gaining traction, the company aimed to assess the regulatory outlook for potential UCITS eligibility of these products in key EU markets. This required insights into regulator positioning and proactive engagement to shape future policy developments. 

Strategy

H/Advisors Brussels was engaged to conduct a cross-jurisdictional assessment of the crypto regulatory landscape in seven EU Member States. The focus was on identifying the approach of national regulatory authorities toward crypto-ETPs and their potential compatibility with UCITS rules. We also examined the role of the European Securities and Markets Authority (ESMA) and broader EU-level trends that could influence future policy directions. 

To support both intelligence gathering and long-term engagement, H/Advisors Brussels secured meetings with all targeted national regulators as well as ESMA.  

Outcome

Through direct engagement and structured analysis, CoinShares gained a detailed understanding of regulatory positions across multiple jurisdictions, including how crypto-ETPs are viewed in the context of UCITS. This enabled the company to refine its business strategy in line with emerging regulatory expectations and to provide more informed guidance to investors. The engagement also laid the groundwork for ongoing dialogue with key regulators, positioning CoinShares as a credible and proactive market participant in discussions around the future of crypto regulation in the EU.
